How Gene Editing Is Transforming Agricultural Regulation

The current challenges faced by food production, driven by climate change on a global scale, have motivated and accelerated advances in scientific knowledge and the application of innovation in agriculture, seeking affordable and effective solutions for farmers and consumers worldwide. As a result, gene editing technologies offer an option, but its potential could only be reached if adequate regulation is applied.
Gene editing technologies have enabled developers to introduce precise changes within an organism's own genetic material without necessarily introducing foreign DNA. As a result, regulators around the world are confronting a fundamental question: Should products that are indistinguishable from those obtained through conventional breeding be regulated in the same manner as transgenic organisms?
Increasingly, the answer is no. What is emerging globally is not deregulation, but rather a more refined and science-based approach.
Shifting from Process-Based to Product-Based Regulation
Historically, biotechnology regulations were developed around the process used to create an organism. If a modern biotechnology technique was involved, the resulting product was often automatically classified as a GMO and subjected to extensive regulatory requirements.
Gene editing has challenged this logic. Most gene-edited plants do not contain foreign DNA and exhibit traits that could have arisen naturally or through conventional breeding methods. In some cases, the resulting genetic changes are identical to naturally occurring mutations and cannot be distinguished.
This scientific reality has prompted regulators to reconsider whether the method used to develop a product should remain the primary determinant of regulatory oversight. Instead, an increasing number of countries are evaluating the final characteristics of the product itself. The central question is no longer, "How was it developed?" but rather, "What is the final organism, and does it present any novel risk?"
Science Is Driving Regulatory Evolution
The regulatory approaches emerging across the Americas are built on a straightforward scientific principle: products that are equivalent to those produced through conventional breeding should be assessed through equivalent regulatory pathways.
This principle reflects decades of scientific understanding. Traditional plant breeding has long relied on methods that generate genetic variation, including spontaneous mutations and induced mutagenesis using chemicals or radiation. More than 3,000 crop varieties developed through these techniques have been cultivated worldwide for decades without being regulated as GMOs.
Gene editing often produces outcomes that are more precise and predictable than these conventional approaches. Importantly, this does not mean such products are left unregulated. Rather, they continue to be regulated under the same agricultural, food safety, seed certification, environmental, and phytosanitary frameworks that govern conventionally developed crops.
The regulatory system remains intact. What changes is the regulatory pathway that applies to the product.
Latin America: The Global Leader in Regulatory Innovation
Latin America has emerged as the world's most active and pragmatic regulatory leader. Beginning with Argentina's pioneering framework in 2015, countries throughout the region have adopted similar mechanisms that evaluate gene-edited products.
Argentina, Brazil, Chile, Colombia, Paraguay, Guatemala, Honduras, Uruguay, Costa Rica, Ecuador, and El Salvador have all developed regulatory approaches that focus on whether a product contains a novel combination of genetic material or an insertion of foreign DNA. If it does, existing GMO regulations apply. If it does not, the product may be regulated through conventional pathways.
This distinction is critical because it demonstrates that gene editing has not required the creation of entirely new regulatory systems. Instead, regulators have adapted existing frameworks to accommodate scientific advances while maintaining appropriate oversight.
A Growing Global Trend
Although regulatory approaches continue to differ among jurisdictions, the overall direction is becoming increasingly clear. Countries across the Americas and parts of Asia are moving toward frameworks that differentiate between transgenic organisms and gene-edited products.
Even within regions traditionally associated with more precautionary regulatory approaches as the European Union, discussions are increasingly centered on how to distinguish products that are equivalent to conventionally bred varieties from those that introduce genuinely novel genetic combinations.
The Future of Agricultural Regulation
Gene editing is doing more than transforming crop development. It is reshaping the focus of agricultural innovation regulation itself. The emerging global trend demonstrates that science-based regulation does not mean less regulation. It means applying the right level of oversight based on the characteristics of the product and the evidence available.
Latin America has become a leading example of this principle in practice. Rather than creating entirely new regulatory structures, countries across the region have shown that existing frameworks can successfully accommodate innovation while maintaining robust regulatory safeguards.
As food systems confront the challenges of climate change, resource constraints, and global food security, regulatory systems must be capable of evaluating new technologies with both rigor and flexibility.
The distinction increasingly being recognized around the world is simple but consequential: not all biotechnology products are the same, and regulation should reflect that reality. The result is not a departure from regulation, but the evolution of regulation toward a more precise, proportionate, and scientifically grounded future.
The regional experience gathered from Latin America and North American countries (the US and Canada) offers Mexico a tested foundation and reference on which to build its own science-based position and applicable regulations on gene editing products, to allow Mexican farmers, producers, and consumers to add gene editing to the toolkit needed to continue growing the competitiveness of Mexico in the agricultural sector.
