Grupo Mexico's Mine Dispute to be Addressed in Mexican Courts

Mexican officials announce that the labor dispute concerning alleged worker rights abuses at Grupo Mexico's San Martin, Zacatecas, will be addressed through Mexico's court system. This issue came to light after the US filed a complaint in June, seeking a review of the matter under the framework of the USMCA.

The US complaint, backed by Los Mineros, the AFL-CIO and the United Steelworkers, alleges that Grupo Mexico violated a 2007 strike at the San Martin mine and engaged in negotiations with employees who lacked proper representation. The dispute revolves around the mine's operations, which involve valuable resources like lead, zinc and copper.

The situation underscores the complexities of cross-border labor disputes. To address this issue, the USMCA introduced the Rapid Response Mechanism to promptly tackle labor abuse allegations and protect workers' rights. However, Mexican authorities have decided not to include this specific case in the trade deal's dispute-resolution process.

The rejection of the US complaint marks a rare instance in which a case has been deemed ineligible for review under the USMCA.

In a joint statement, Mexico's economy and labor ministries assured that the ongoing concerns raised by the US are being addressed through the Mexican judicial system, and a final resolution is anticipated in the near future.

Therefore, it is crucial for companies to grasp the rules of origin and vigilantly monitor regulatory compliance matters to maximize the agreement's advantages,” says  Alberto Villarreal, Managing Director, Nepanoa LLC.
