Minaurum Gold Secures Amparo to Safeguard Alamos Project
Minaurum Gold announced that the amparo it filed to protect its Alamos project in Sonora has been approved by the Mexican Federal Administrative Court. This decision ensures that the company's Alamos silver project remains unaffected by the Mining Law Reform.
Minaurum reported the positive result of this amparo: the Alamos project will not be affected by the Mining Law approved by the Mexican Congress in 2023, resulting in de-risking the project from potential disruptions. “We are very pleased with the positive Court decision that protects our flagship Alamos silver project. This ruling ensures that Alamos will continue to be governed by the Mexican Mining Law of 1992 and will not be subject to the uncertainties caused by the new Mining Law Reforms,” said Darrell Rader, President and CEO, Minaurum Gold
The Mining Law Reform was approved by the Mexican Congress on May 9, 2023, and subsequently published in the Official Gazette (DOF). In response, Minaurum filed amparos to safeguard its Mexican projects. The company is awaiting further correspondence from the Court regarding the remainder of its Mexican project portfolio.
On March 8, 2024, the Supreme Court (SCJN) published a binding ruling questioning 25 aspects of reforms to laws governing Mining, National Waters, General Ecological Equilibrium, and Waste Management. In addition, it granted a temporary suspension to protect the rights of companies with active concessions. To date, companies have filed over 500 amparos against the reform, arguing that their rights to legal certainty, legality, and legitimate expectations are being undermined by the reforms, as reported by MBN.
