CRE Declares Expiration of 205 LPG Permits Due to Inactivity

CRE has announced the expiration of 205 permits related to various activities within the liquefied petroleum gas (LPG) industry due to inactivity for at least one year, as mandated by Art. 55, Section I, Subsection b) of the Hydrocarbons Law.

CRE's decision, published in the Official Gazette of the Federation under Agreement A/077/2023, signifies the loss of rights for the permit holders. To warrant expiration, three conditions must be met: the existence of a permit enabling specific activities regulated by the law, cessation of exercising rights conferred by the permit holder for 365 consecutive days, and verification by the Commission of this inactivity through electronic records associated with the permit holder.

CRE scrutinized electronic and physical documentation associated with each of the 205 permits, affirming the lack of activity for a period of at least 365 consecutive days. The review spanned from Jan. 1, 2022, to July 14, 2023. Among the companies affected by this decision are Industrial Lechera, S.A. de C.V., Gas Rex de México, S.A. de C.V., Gas Mundial de Acapulco, S.A. de C.V., Suministro de Gas de Campeche, S.A. de C.V., Transportes de Gas Peninsular, S.A. de C.V., and Pia Gas, S.A. de C.V.


CRE emphasized that affected parties have the right to challenge this administrative act through indirect amparo proceedings, as stipulated by the Law of Coordinated Energy Regulatory Bodies, before the judicial bodies of the Federal Judiciary, within the timeframe established in the Amparo Law, Art. 103 and 107 of the Constitution.
