CNE Ends Asymmetric Regulation on PEMEX Contracts

Mexico’s National Energy Commission (CNE) officially eliminated all asymmetric regulations governing PEMEX and its subsidiaries, ending a decade-long framework that dictated how the state-owned company interacted with private clients.

The new agreement nullifies all administrative acts related to “First-Hand Sales” and asymmetric regulation previously issued by the now-defunct CRE. According to CNE’s decree, all prior rules, pricing directives, transparency requirements, and open access conditions affecting PEMEX’s wholesale and contractual operations are no longer in force.

The resolution marks the formal conclusion of the regulatory regime established in 2013 following Mexico’s energy reform, which sought to limit PEMEX’s market dominance and encourage competition. With this move, CNE assumes full regulatory authority and sets the foundation for a new supervised competition model.

The agreement’s annex lists repealed provisions, including methodologies for price calculation, information disclosure obligations, and contractual terms imposed by the CRE.

CNE’s announcement also includes provisions for ongoing contracts. According to Art 3 of the transitory clauses, contracts signed before the agreement’s enforcement will remain valid until they are converted into commercialization contracts, in accordance with the Hydrocarbons Sector Law (LSH). Any obligations conflicting with the new agreement are rendered void.
