Amparo Law Reform Moves Forward Without Retroactive Article

Julio César Moreno, MORENA Deputy and Chair of the Justice Committee in the Chamber of Deputies, announced that the transitional article introducing retroactivity to the Amparo Law reform has been removed from the draft. “I have great respect for my Senate colleagues, but it was a rather impulsive idea, and we are here to correct it,” Moreno said.

The transitional provision was originally proposed by MORENA legislator Manuel Huerta, despite opposition from President Claudia Sheinbaum. “Specifically, the Senate’s language on retroactivity has been removed and replaced with the version proposed by the President.”

The draft reform will be reviewed by the Chamber’s Justice and Finance committees on Oct.  13 with a possible full vote on Oct. 15, according to MORENA. Opposition parties, however, secured a preliminary commitment that public forums will take place before the vote.

Ricardo Monreal, MORENA’s leader in the Chamber and Chair of the Political Coordination Board, stated that the approval could move forward next week, regardless of whether open debate occurs. 

The PAN parliamentary group celebrated this as a “citizen victory.” PAN Vice Coordinator Federico Döring warned that presenting a draft without retroactivity was insufficient, as other rule changes could still occur. He emphasized that all provisions will be up for debate. 

Both PAN and Movimiento Ciudadano (MC) formally requested a broad discussion of the reforms. MC Deputies Juan Zavala and Pablo Vázquez Ahued argued that rushing the reforms has led to incoherent and contradictory legislation that does not address the country’s problems.
